Students Rights in United States

As part of community, students have civil rights that are always good to know. As any american citizen, students are shed their constitutional rights with some slight differences. Right to freedom of expression “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” First Amendment to the US Constitution Any  school student have the right to freedom of expression as long as they do not disrupt normal function of school or violates others’ rights, that means that you cannot say anything at school: if you tell hurtful lieas about others you are violating his/her rights! Personal belongins “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated….” Fourth Amendment to the US Constitution Fourth Amendment to the US Constitution allows officers to search your personal belongins when they have a “probable cause” that could turn into a school security threat in your are outside school facilities but when staying at school facilities, officials do not need a warrant or probable cause to search a student’s belongings. Instead, students could be searched on “reasonable suspicion” — more than a mere hunch — that they have violated a law or school rule. You have to be aware that as lockers are school property they can be searched at any time . Discrimination and unfair treat “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State…deny to any person within its jurisdiction the equal protection of the laws.” Fourteenth Amendment to the US Constitution Any school can discriminate againts any student because of race , gender, religion or sexual orientation.
